I agree with your comments below and thank you for your participation.
When looking at borderline cases, such as those where the monitors disagree,
it is difficult for a third umpire (such as the Alt Chair) to decide which
way to jump. Whatever way I decide will be against one or the other. On
the other hand, sooner or later a decision will be made.
I don't see any benefit in fudging further by asking you or others for your
view. That would just postpone the decision and prolong the process. So
I'll take it as Alternate Chair.
My view is clear. Kent Crispin is the voice of ICANN staff and is a
necessary evil who must be tolerated. Most of the time he provokes
constructive debate. This ends up being a fuller and richer debate. For
that input I am grateful. I have said before that I would be most reluctant
to suspend valuable contributors.
However, it is clear that Kent has got some sort of grudge against certain
people and this comes out from time to time. It is not an argument on its
merits but a personal attack.
I don't agree with Kristy that we are more-or-less forced to suspend
somebody on a second warning. That overstates the case. However, Kent has
often been rude to people. And he has been warned.
So I'd suspend him for two weeks.
