Jonathan,

One key point seems missing, and relevant to the
current dialogue:

In light of the historical expansion of the DNS root zone
by scores of new Top Level Domains per year over the
past fifteen years unfettered by significant non-technical
requirements, and

in light of the ICANN being bound by its Articles of
Incorporation to "enable...open entry in Internet-related
markets, as well as applicable antitrust laws,

can ICANN or any of its subsidiary organs lawfully establish
policies that result in substantially diminishing this rate
of increase, or restrict entry on other than the open bases
it has been?
