I like Tim's proposed re-wording. I would note that many UDRP
decisions have in effect classified "non-use" as evidence of 
bad faith. The effect is to completely undermine the original
intent and wording of the policy.

Do you believe both registration and use [in bad faith] should be required
[to satisfy the] bad faith [requirement]?  (My changes in brackets.  This
more closely follows the language of the Policy.)
